Jonn and Mary bought a large piece of property that adjoins a hog farm. When they bought, the farm operations were not close to their property but the operations expanded and now some of the pens are very close to their property line. The hog farm now has noxious odors that make it difficult for them to go outside, and, on occasion, hogs get loose and come on to their property. When that happens the employees also go on John and Mary’s property to collect the hogs who do destroy the vegetation and leave a general mess. Do John and Mary have any rights to protect themselves? How should they take action to preserve the value and enjoyment of their property? They are thinking of renting the property to tenants. Is that a good idea?
