In June 2018, The U.S. Supreme Court ruled in favor of a Colorado baker who refused to sell a cake to a gay couple on religious grounds (Masterpiece Cakeshop, Ltd. v. Colorado Civil Rights Commission). The baker believes that decorating cakes is a form of art (expression) through which he can honor God and that it would displease God to create cakes for same-sex marriages. Therefore, in his view, selling a cake to the couple would force him to endorse their same-sex marriage, and thus infringe on free speech rights. The aggrieved couple filed a discrimination complaint with the state arguing that the baker’s refusal violated a state law that prohibits discrimination based on sexual orientation. Question to answer: Does the Supreme Court ruling allow for discrimination? How does the government rectify the First Amendment right to freely practice one’s religion with civil right laws that forbid denial of service, employment, or housing?
