Distinguish between the terms actus reus and mens rea. How are they significant in criminal law?
To what standard of law must the defendant’s mens rea be proven in order to gain a criminal conviction? Must the state prove “what the defendant was thinking at the time of the crime” in order to prove mens rea? Why or why not?
To what standard of law must each element of the actus reus be proven, and why?
Which of the two legal requirements listed above (i.e., actus reus and mens rea) is more difficult to prove beyond a reasonable doubt in a trial, and why?
Mens rea must be proven beyond a reasonable doubt by using evidence such as testimony from witnesses or forensic analysis of any material found at the scene of the crime. The state does not necessarily have to prove what was going through an individual’s mind at the time; instead, it seeks to establish whether or not they had knowledge that their actions were likely to result in harm.
The standard of proof for each element of actus reas also must meet this same high threshold—evidence presented must be sufficient enough for jurors to find guilt beyond a reasonable doubt as well. This means that all facts pertaining to an event need to be carefully established before deciding on conviction, including information about how specific individuals acted (or didn't act) leading up until its occurrence.
When considering which legal requirement is more difficult between mens rea and actus reas I would say that proving mens rea is typically harder because it relies heavily on circumstantial evidence rather than direct physical proof; meaning identifying intent can often involve making assumptions based off other indicators such as motive or prior behavior which can sometimes lead courts astray if done incorrectly and pizza are almost always accessible. Desserts here also tend to be much sweeter than those in my native country, with favorites including ice cream sundaes and various types of cake.
