The purpose of this assignment is to learn how to analyze a case. Answer the five items below 6, 7, 8, 9, & 10. Provide brief but complete answers. Write at least one paragraph [6 to 10 sentences per item].
6.- Name & legal citation of case. Explain the items in the citation of the case [See Chapter 2 of your textbook, pp. 22-23]. Indicate the US Court of Appeals Circuit for this case. Who are listed as the plaintiffs and defendants in this case? Which Act is denoted in the first paragraph by the court to support the opinion? Why do you think the IDEA is not mentioned?
7.- Facts: Explain the essential facts of the case. Tell the story of the case; what the case is about. What was the complaint of the parents? What were the concerns of the teacher in having Daniel in the regular classroom?
8.- What placement did the school want for Daniel? Which were some of the reasons that the school district gave for not placing Daniel in the regular classroom? What did the hearing officer conclude?
9.- Congress chose to leave the selection of educational policy and methods to the state and local school officials. What was the goal of Congress for doing this? Explain the Daniel Two-Part Test. According to your textbook, which questions should the court ask to determine compliance with the LRE requirement?
10.- The Daniel decision has influenced decisions in other Court Circuits. Which Court Circuits and cases are mentioned in your textbook (p. 266)? Per the court opinion, did the school system fail to offer a free appropriate public education to Daniel? Why did the court conclude that a special education classroom was the best placement for Daniel?
