In light of the mortgagee’s right to possession “as soon as the ink is dry on the mortgage,” Four-Maids Ltd v. Dudley Marshall (Properties) Ltd (1957) and any subsequent right of the mortgagee to exercise the power of sale of the mortgaged property, critically analyse the protection the law provides to mortgagors who default on their mortgage repayments.
