Select an act that addresses ONE of the following environmental issues: air, water, toxics, or wastes. Then, find the appropriate FEDERAL law. Trace it from Congressional act to federal law to regulation to promulgation at the state/enforcement and implementation. You should research this and make sure you are clear on how this process works. Then, find at least ONE federal case that challenge (not necessarily overrule or reverse) the regulations and law. What is the basis for reversal? What is the argument? Is it a common law? Tort? Economic? Ethics? Precautionary? What was the challenge based on? Provide your argument for why the law was sound (or unsound) and should be enforced, overturned or modified.
