Discuss the goals of a victim-witness program. In what ways are they complex or conflicting? In what ways do some goals serve as constraints?
While these goals present an opportunity for victims and witnesses to receive much needed aid during this difficult time in their lives, they also may create conflicting dynamics in some cases. For example, there could be issues around confidentiality where a victim might be reluctant to report something out of fear that doing so would put them at further risk if it was shared with other parties outside of the court proceedings (such as law enforcement). Additionally, there may be limitations on how much support a program can give due to factors like limited resources or staffing constraints which could leave some applicants without assistance when they need it most.
Additionally, some goals associated with these programs may also act as constraints on victims’ rights depending on what is included within each particular jurisdiction’s laws surrounding them. In certain areas, victims might have fewer protections than those offered under state statutes leading them to feel trapped within an unjust system without hope for change or reparation from any wrongdoings committed against them – leaving many feeling disempowered rather than supported by these efforts which were intended to help provide just that very thing.
